1. Acceptance of Terms
By creating a Moblio account, using the AI prompt building interface, running live app previews, or deploying codebases via our dashboard, you agree to be bound by these Terms & Conditions ("Terms"), all applicable laws, and regulations.
If you are entering into this agreement on behalf of a company, organization, or another legal entity, you represent that you have the authority to bind such entity and its affiliates to these Terms. If you do not agree to these Terms, you must not access or use the Services.
2. Description of Service
Moblio provides an AI-orchestrated mobile app builder. Users input design ideas, descriptions, or visual references ("Prompts"), and our system plans database structures, writes React Native source code, sets up third-party services (such as Stripe and RevenueCat integration), and offers a compilation and submission pipeline to push apps to user-configured App Store Connect and Google Play console developer accounts.
Moblio reserves the right to modify, suspend, or discontinue any aspect of the Services at any time, including updates to backend models, build systems, or subscription tiers, without prior liability.
3. Accounts & Billing
To utilize our platform features, you must register for an account. You are responsible for safeguarding your credentials and for all operations occurring under your workspace.
Subscriptions & Billing Cycles
We offer free credits to test compilation. Ongoing generation and publishing capabilities require active subscriptions (monthly or yearly Pro plans).
- Billing: Subscriptions are billed in advance on a recurring basis via Stripe.
- Cancellations: You can cancel your subscription at any time via your billing dashboard. Upon cancellation, you will maintain access to Pro features until the end of your current billing period.
- Credits: Credits allocated as part of subscription tiers expire at the end of the monthly billing cycle and do not roll over.
- Refunds: Since generative AI resources are consumed instantly during code generation and compilation, subscription payments are non-refundable except as required by law or as expressly agreed at our discretion.
4. Code & IP Ownership
We believe in developer freedom. We do not enforce vendor lock-in:
- Your Code: You own 100% of the Intellectual Property (IP) rights, source code files, asset configurations, database designs, and project layouts generated by the AI models through Moblio.
- Platform IP: Moblio retains all ownership, title, and interest in the editing software, compiler toolchains, web design, trademarks, branding assets, and server infrastructure.
- Licensing: By generating code on our platform, you grant Moblio a temporary, non-exclusive, worldwide, royalty-free license to store, compile, and host your generated code solely to deliver the preview rendering, testing, and deployment features of the Services to you and your authorized team members.
5. AI Content Disclaimer
Moblio relies on large language models (LLMs) to write software. You acknowledge and agree to the following AI-specific provisions:
⚠️ Code Quality: AI models can make logic mistakes, introduce bugs, create security vulnerabilities, or output deprecated code. Moblio does not audit the generated code for security, efficiency, or correctness.
⚠️ Verification Obligation: You are solely responsible for testing, auditing, and verifying all generated codebases before launching your application or submitting it to public app stores. You assume all risks associated with deploying code generated by the Services.
⚠️ Compliance: You are responsible for ensuring that your generated applications comply with Apple App Store Review Guidelines, Google Play Developer Policies, and general consumer laws.
6. Prohibited Activities
You agree not to engage in any of the following prohibited behaviors:
- Using our AI APIs to generate malicious code, spyware, spam tools, or applications designed to scam users.
- Attempting to bypass credit controls, scrape platform endpoints, or reverse-engineer our proprietary compiler toolchains.
- Hosting illegal content or launching denial of service attacks via Moblio Cloud database and preview servers.
- Representing that Moblio has endorsed, certified, or audited your generated application.
7. Liability & Indemnity
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBLIO AND ITS OFFICERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES OR ANY CODE GENERATED THEREBY.
You agree to defend, indemnify, and hold harmless Moblio and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including attorneys' fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; or (iii) any claims that an application generated by you violates third-party intellectual property or privacy rights, or breaks applicable retail app store guidelines.
8. Termination & Governing Law
We may suspend or terminate your account and block access to the Services immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the editing and hosting platforms ceases, but you retain ownership of any codebases successfully synced to your local storage or external repositories prior to termination.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
